Who we are
HamacWeb is a Canadian platform that designs, hosts and maintains websites for businesses, on a subscription basis. By using HamacWeb or paying for a subscription, you accept these terms. They are meant for businesses and self-employed people who use the service for commercial purposes.
The service
We build your website custom and keep it alive: adding pages, a blog, updates to your menu, prices and photos, design refreshes. You send us your requests by form or by text, and we take care of them. The site is custom built for you; the subscription is what keeps it online and up to date.
Subscription and billing
The subscription is paid in advance, monthly or yearly, depending on the plan you choose. Prices are shown before payment and may be subject to applicable taxes. Payments are processed by Stripe, our payment provider; we do not keep card numbers. As long as the subscription is active and paid, your site stays online and maintained.
Refunds and cancellation
Annual plan: non-refundable. The annual subscription is paid in advance for twelve months and is not refundable, in whole or in part, once payment is made. In return, your service stays active and maintained until the end of the paid period: you do not lose what you paid for. We send you a notice before each annual renewal, and you can choose not to renew, at no cost.
Monthly plan: cancel anytime. You can cancel whenever you want; cancelling stops future charges. The month already paid is not refunded, and your site stays online until the end of the current month.
These rules apply between businesses. Nothing here removes rights the law grants you where they still apply.
What you provide
You are responsible for the content you give us (text, images, logos, reviews, contact details) and you confirm you have the right to use it. You agree not to provide anything illegal, misleading, or that violates the rights of others. Your content and your domain name stay yours.
Our work
We take great care to deliver a quality site and to answer your requests quickly. The platform, the code and the tools that run HamacWeb remain our property. You get a custom site and the service that keeps it alive, not a licence on our technology.
Availability
We aim to keep your site online at all times, but no web platform can guarantee uninterrupted operation (maintenance, a provider outage, force majeure). We fix issues as fast as we can.
Limitation of liability
HamacWeb cannot be held responsible for indirect losses (loss of revenue, clientele or data) linked to the use or interruption of the service. Our liability, if any, is limited to the amount you paid for your subscription over the last twelve months.
Changes
We may update these terms from time to time. The version in force is always the one published on this page, with its update date. If a change is significant, we let you know.
Governing law
These terms are governed by the laws of Quebec and Canada. Any dispute falls under the courts of Quebec.
